Report: Issues with WWE trademarking Sin Cara

According to a report by PWInsider.com, WWE is having some problems trademarking the name “Sin Cara.” Based on the report, WWE applied to register the name back in February and were told the following month by the USPTO that they must clarify whether the name or signature identifies a living individual. It added, “Written consent is required for registration of a name, including a pseudonym, stage name or nickname, or signature, if the name or signature identifies a specific living individual.” WWE responded to this claim last month stating, “The name(s), portrait(s), and/or signature(s) shown in the mark does not identify a particular living individual. The mark represents a stage name that is owned by Applicant.” Just days ago, the USPTO responded saying that response was unacceptable. It appears the next step is requiring written consent from Sin Cara that would authorize WWE to register the name as a trademark. WWE has six months to either appeal or submit a response that meets these requirements.
