Report: Hulk Hogan’s family files petition over potential malpractice claim

Brandon Thurston of POST Wrestling has reported that the family of Hulk Hogan has filed a petition in Pinellas County, seeking an extension of 90 days to Florida’s statute of limitations in order to investigate a potential medical malpractice claim.

The petition was filed on behalf of the WWE Hall of Famer’s widow Melanie Sky Daily, along with his son Nick Bollea and financial Terry McCoy, who represent the estate.

No lawsuit has been filed yet, but the filing states that the family wants to investigate claims against Tampa General Hospital, Morton Plant Hospital, two Florida-based doctors, and “any and all other applicable health care providers.”

The petition comes after the report of Daily planning to file a medical malpractice case for claims she says led to Hogan’s death in July.

A neck surgery in May may be viewed by the estate as the alleged negligence, with the new petition adding onto the time limit set by section 95.11(5)(c) of the Florida Statutes, in which medical malpractice claims must be brought within two years of the incident or its discovery, and no later than four years from when the alleged malpractice itself occurred.
